Plaintiff has filed suit against defendant to recover costs of custom wheel rims.

“I, (your name here), do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as a (United States District Judge, United States Bankruptcy Jjudge, or United States Magistrate Judge, etc.) under the Constitution and laws of the United States. So help me God.”

Hear the CaseA lawyer presents evidence in court on behalf of his client.

In the opening statements, ABC Manufacturing’s lawyer explains that the defendant, Hi-Speed Auto Supply, ordered and accepted delivery of custom-made wheel rims but refuses to pay for them as contracted. Hi-Speed Auto Supply ‘s lawyer explains that the evidence will show that his client is not responsible for payment because the plaintiff delivered a faulty product.

In the examination and cross-examination, and through evidence, you learn that the rims on the ABC website do appear to be better quality than the ones received by Hi-Speed Auto Supply. However, the ABC contract agreed to by Hi-Speed does not allow returns or refunds for custom orders.

Hi-Speed Auto Supply’s lawyer argues that ABC violated the contract knowingly shipping a faulty product and that Hi-Speed should not be responsible for payment.

Is Hi-Speed Auto Supply responsible for ABC’s costs?
